Looking back on the year of NDIS amendments

Presenters: Dayne Kingsford and Kiran Marfatia

Synopsis: A year in retrospect for the NDIS Act Amendments, with a view to exploring the relevant changes the National Disability Insurance Scheme Amendment (Getting the NDIS Back on Track No.1) Act 2024 and the interplay with the ART, through the lens of access and support decisions, and the recent judgment of NDIA v Lampard [2025] FCAFC 139.

Dayne Kingsford practices primarily in public law, with a particular interest in merits and judicial review, human rights and discrimination and native title. He also accepts briefs in general commercial and employment law. Before coming to the Bar, Dayne worked as a Senior Legal Officer within Queensland’s Department of Justice. He was previously a Principal Solicitor of a human rights practice at a community legal centre, where he advised and appeared in matters related to guardianship and administration, anti-discrimination, human rights and royal commissions. Dayne has published research on administrative decision-making and has taught at the Queensland University of Technology.

Kiran Marfatia practices in public and administrative law, including merits and judicial review proceedings, as well as in general and appellate civil law matters. Prior to coming to the Bar, Kiran practiced as a Solicitor within the Civil Claims Team at the Australian Government Solicitor, where he handled a wide range of common law tort and public law matters. Kiran was also an Associate at Maddocks, advising on regulation, statutory interpretation, and governance for statutory and government bodies. His experience includes managing merits review within the National Disability Insurance Agency jurisdiction, from alternative dispute resolution to hearing.
