Jonathan Horton KC on Model litigant obligations
5.30pm (AEST), 25 February 2025
Sparke Helmore Lawyers, Level 23, 240 Queen Street, Brisbane
Presenter: Jonathan Horton KC, Barrister at Law, 18 Inns Barristers Chambers
Chair: Matthew Paterson, Barrister at Law, North Quarter Lane Chambers
Government is held to the standard of a ‘model litigant’. This is not mere rhetoric, but requires of the lawyer a conscious awareness of the place of government in litigation, and the standards to which it is held. What then is the content of the standard and its limits? How in practice is a lawyer expected to give effect to it? What correctives are available if something falls below standard?
Jonathan Horton KC has a generalist practice, with particular experience in public law, both litigious and advisory. He has been involved in many commissions of inquiry and other matters of public interest. His practice spans the full range of perspectives on public law, regulation and Government decision-making. He often acts in a lead-in capacity to assist with good decision making. He regularly acts for (and against) government.
Jonathan holds a Bachelor of Laws (first class Honours) from Sydney University, a Bachelor of Arts from the Australian National University and a Masters and a PhD in Law from the University of Edinburgh.
Matthew Paterson is a barrister, practicing across a broad range of public law and commercial disputes. He is currently the national Vice President and Queensland Chapter Secretary of the AIAL. He is a member of North Quarter Lane Chambers. Prior to being called to the Bar, Matthew worked at MinterEllison. In 2019, he was associate to his Honour Justice JA Logan RFD of the Federal Court of Australia. From 2017 to 2018, he was an associate at the Administrative Appeals Tribunal.
